TERMS OF SERVICE

GREEK HOUSE APP LLC, a California Limited Liability Company

1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and GREEK HOUSE APP LLC (“Company,” “GREEK HOUSE,” “we,” or “us”) governing your access to and use of the GREEK HOUSE mobile application (the “App”). By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the App.

2. Eligibility & Invitation-Only Access

Use of the App is strictly limited to individuals who:

  • Are at least eighteen (18) years old
  • Are verified members of a recognized fraternity or sorority
  • Have received an invitation from an authorized chapter administrator

The App is private and invitation-only. The Company reserves sole discretion to approve, deny, suspend, or revoke access at any time, for any lawful reason.

3. Account Responsibility

You agree to:

  • Provide accurate and complete information
  • Maintain confidentiality of login credentials
  • Accept responsibility for all activity under your account

The Company is not liable for unauthorized access resulting from your failure to safeguard credentials.

4. Subscription Terms

Annual Subscription
Access to full App functionality requires payment of a $52 annual subscription, billed in advance. Subscriptions:

  • Automatically renew annually unless canceled prior to renewal
  • Are non-refundable except as required by applicable law
  • May be canceled through your App Store account settings

The Company reserves the right to change subscription pricing with reasonable notice.

5. Chapter Payments & Transaction Fees

The App enables fraternity and sorority chapters to collect member payments via Stripe.

  • All payment processing is handled by Stripe.
  • GREEK HOUSE APP LLC retains a 2% platform transaction fee from chapter payments processed through the App.

The Company:

  • Is not a bank or financial institution
  • Does not hold funds on behalf of users
  • Is not responsible for chapter financial disputes
  • Disclaims liability for payment failures, chargebacks, or fraud

Chapters are solely responsible for compliance with applicable financial and tax laws.

6. User Content & License

Users may upload photos, videos, messages, and other content (“User Content”). You retain ownership of your User Content but grant the Company a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute such content solely for operation of the App. You represent and warrant that:

  • You own or have rights to all uploaded content
  • Your content does not violate law or third-party rights

The Company reserves the right to remove content at its sole discretion.

7. Conduct & Assumption of Risk

You acknowledge that:

  • The App facilitates social and dating interactions.
  • The Company does not conduct background checks.
  • The Company does not guarantee the character, identity, or conduct of any user.

You assume all risks associated with interactions with other users, both online and offline. The Company shall not be liable for user conduct, harassment, fraud, or personal injury arising from use of the App.

8. Indemnification

You agree to indemnify, defend, and hold harmless GREEK HOUSE APP LLC, its officers, members, managers, affiliates, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys’ fees) arising from:

  • Your use of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of any law or third-party rights

9. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • UNINTERRUPTED OR ERROR-FREE SERVICE

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW: THE COMPANY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES. IN NO EVENT SHALL THE COMPANY’S TOTAL LIABILITY EXCEED THE GREATER OF:

  • THE AMOUNT YOU PAID IN THE PREVIOUS TWELVE (12) MONTHS
  • ONE HUNDRED U.S. DOLLARS ($100)

11. Arbitration Agreement & Class Action Waiver

Binding Arbitration
Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in California.

Waiver of Jury Trial
YOU WAIVE ANY RIGHT TO A JURY TRIAL.

Class Action Waiver
YOU AGREE THAT DISPUTES SHALL BE RESOLVED INDIVIDUALLY AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

12. Termination

The Company may suspend or terminate accounts at its sole discretion, without prior notice, for violation of these Terms or misuse of the App.

13. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

This Privacy Policy describes how we collect, use, disclose, and safeguard personal information in connection with the App.

2. Information We Collect

We collect:

  • Personal Information
    • Name
    • Email address
    • Phone number
    • Greek affiliation and chapter
    • Profile photos, videos
  • User Communications
    • In-app messages
    • Chapter-wide communications
  • Payment Information
    • Processed by Stripe. We do not store full credit card details.
  • Technical Data
    • Device identifiers
    • IP address
    • Log data
    • Usage analytics

3. Use of Information

We use collected information to:

  • Operate and maintain the App
  • Verify invitation-based access
  • Process subscriptions
  • Facilitate chapter payments
  • Send communications via Resend
  • Detect fraud and prevent misuse
  • Comply with legal obligations

4. Sharing of Information

We may share information with:

  • Stripe (payment processing)
  • Supabase (data storage infrastructure)
  • Resend (email communications)
  • Analytics providers

We do not sell personal information.

5. Data Retention

We retain personal information as long as necessary to:

  • Provide services
  • Comply with legal obligations
  • Resolve disputes
  • Enforce agreements

6. California Privacy Rights (CCPA/CPRA)

California residents may request:

  • Access to personal data
  • Deletion of personal data
  • Information about data processing

7. Data Security

We implement commercially reasonable administrative, technical, and physical safeguards.
However, no system is completely secure.

8. Account Deletion

Users may request deletion within the App or via email.

9. Children’s Privacy

The App is not directed to individuals under 18. We do not knowingly collect data from minors.

10. Changes to This Policy

We may update this Privacy Policy periodically. Continued use constitutes acceptance of changes.
